HIPAA NOTICE OF PRIVACY PRACTICES

As Required by the Privacy Regulation Created as a Result of the Health Insurance Portability and Accountability Act of 1996 (HIPAA)

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN ACCESS THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

OUR COMMITMENT AND LEGAL DUTY TO YOUR PRIVACY
The Ultimate Care, LLC is dedicated to protecting your privacy and the confidentiality of your Protected Health Information (PHI). We are required by applicable federal and state laws to maintain the privacy of your PHI and provide this Notice to inform you about our privacy practices, legal obligations, and your rights concerning your PHI. We are committed to upholding these practices in accordance with this Notice while it remains in effect.

We reserve the right to change our privacy practices and update the terms of this Notice as permitted by law. Any changes will apply to all PHI we maintain, including any information created or received prior to the changes. A current version of this Notice will always be available upon request.

USES AND DISCLOSURES OF YOUR PROTECTED HEALTH INFORMATION (PHI)
The Ultimate Care, LLC may use and disclose your PHI for the following purposes:

1. Treatment
We may use or disclose your PHI to provide, coordinate, or manage your healthcare and related services. This includes sharing information with other healthcare providers involved in your care, such as doctors, specialists, or hospitals.

2. Payment
Your PHI may be used and disclosed for billing purposes to obtain payment for the services provided by The Ultimate Care, LLC. For example, we may share your PHI with your insurance company to verify coverage or process claims.

3. Healthcare Operations
We may use and disclose your PHI for our business operations, such as quality assessment, employee training, accreditation, or licensing activities. This helps us ensure that we provide quality care to all our clients.

4. Your Authorization
Beyond treatment, payment, or healthcare operations, we will only use or disclose your PHI with your written authorization. You may revoke this authorization at any time, but it will not affect any use or disclosure made while the authorization was in effect.

5. Family and Friends Involvement
With your consent, we may disclose your PHI to family members, friends, or others involved in your care or payment for your care. In emergency situations, we may use our judgment to determine if it is in your best interest to share information.

6. Appointment Reminders
We may use your PHI to contact you with reminders about upcoming appointments via phone, email, or text messages.

7. Public Health and Safety
We may disclose your PHI to authorized public health authorities to prevent or control disease, report abuse or neglect, or if we believe it's necessary to avert a serious health or safety threat to you or others.

8. Required by Law
We may use or disclose your PHI when required by federal, state, or local law, including in response to a court order, subpoena, or legal process.

9. Research and Organ Donation
Under specific circumstances, we may use or disclose your PHI for research purposes or to organizations involved in organ and tissue donation and transplantation.

If you are or have been a member of the military, we may disclose your PHI as required by military command authorities. We may also disclose your PHI for national security or intelligence purposes.

11. Worker’s Compensation
We may disclose your PHI as authorized to comply with worker's compensation or similar laws.

PATIENT RIGHTS
1. Right to Access

You have the right to access and obtain a copy of your PHI, either electronically or on paper. To request access, please submit a written request using the contact information provided at the end of this Notice. There may be a reasonable, cost-based fee for copies.

2. Right to Amend
If you believe your PHI is incorrect or incomplete, you may request an amendment in writing, explaining why the information should be corrected. We may deny your request under certain circumstances, but we will provide an explanation.

3. Right to an Accounting of Disclosures
You have the right to request a list of certain disclosures of your PHI that were made outside of treatment, payment, and healthcare operations.

4. Right to Request Restrictions
You may request that we limit the use or disclosure of your PHI for treatment, payment, or healthcare operations, or restrict disclosures to family members or others involved in your care. While we will consider your request, we are not required to agree unless you have paid for the services in full out-of-pocket.

5. Right to Confidential Communications
You have the right to request that we communicate with you in a certain way (e.g., at work or by mail) to maintain your privacy. We will accommodate all reasonable requests.

6. Right to Receive a Paper Copy of This Notice
You are entitled to receive a paper copy of this Notice upon request.

7. Right to Be Notified of a Breach
You have the right to be notified in the event of a breach of your unsecured PHI.

​

8. Right to File a Complaint
If you believe your privacy rights have been violated, you have the right to file a complaint with The Ultimate Care, LLC or with the U.S. Department of Health and Human Services. We will not retaliate against you for filing a complaint.
